What PIC 4020 means
PIC 4020 applies when the Department is satisfied that an applicant provided, or caused to be provided, false or misleading information (3-year ban) or a bogus document (10-year ban) in connection with the visa application.
The ban runs from the date of the refusal decision and applies to most visa categories. This means that even after the ban period ends, the PIC 4020 finding remains on your record and will be considered in future applications.
PIC 4020 is separate from the relationship assessment. You could have a genuine relationship and still trigger PIC 4020 if a document in your application was found to be fraudulent, even if you did not know it was fraudulent.
Can you challenge it at the ART?
Yes. If you have review rights, the ART will make its own assessment of both the relationship and PIC 4020. The Tribunal member will look at the evidence fresh and decide independently whether the relationship is genuine and whether PIC 4020 should apply.
For the relationship, bring concrete evidence of your life together. For PIC 4020, address the specific document or information that triggered the finding. If the document was genuine, prove it. If you did not provide it and did not know about it, present evidence of that.
