Why student visas get refused
Most student refusals trace back to one of these areas:
- The Genuine Student requirement was not met. This replaced the Genuine Temporary Entrant test on 23 March 2024, and it asks whether you are a genuine applicant for study.
- The Department was not convinced the course fit your study and career history, or that the reasons for the choice stacked up.
- Financial capacity was not shown, meaning the evidence of funds for tuition, living costs and travel was thin or inconsistent.
- English language evidence was missing or below the required level for the course.
- Gaps in study, weak documents, or answers at interview that did not match the written application.
- Health, character or previous visa history issues.
Student visa criteria sit under the Migration Act 1958 and the Migration Regulations 1994. A refusal usually turns on the Department not being satisfied about one specific point, so the appeal has to target that point rather than restate the whole application.
Appeal eligibility
Whether you can seek review depends on where you were when you applied. If you lodged your student visa application in Australia and it was refused, you can usually apply to the ART yourself. If you applied offshore, review rights are more limited and often are not available. The refusal letter will tell you if you have review rights and how long you have. For onshore student refusals the deadline is commonly short, so confirm your date straight away and do not wait for the new semester to sort itself out.

- Sort out your bridging visa so you stay lawful and, where allowed, can keep studying.
- Gather evidence that answers the exact reason for refusal, such as clearer financials, a stronger statement addressing the Genuine Student criteria, or updated English results.
- Attend the hearing, which for student matters is increasingly short or decided on the papers, and answer the member’s questions directly.

What if the ART agrees with the refusal?
You may be able to apply to the Federal Circuit and Family Court for judicial review within 35 days, but only where a legal error was made. It is a narrow avenue, so get advice on whether it fits your case.
