Review rights depend on how your visa was cancelled

For cancellations under section 109 or 116, you generally have ART review rights. The deadline is 21 days from deemed receipt of the cancellation notice (or 7 working days if you were in immigration detention when notified). The ART conducts a fresh merits review and can set aside the cancellation, restoring your visa.

For mandatory cancellations under section 501 (character grounds), you do not have standard ART review rights. Your avenue is to make representations to the Minister for revocation of the cancellation under section 501C. This is a different process with different rules.

Check your cancellation notice for the specific section used and your review rights. Count the days from the deemed date of receipt. If you have review rights, lodge within the deadline. If the cancellation was under section 501, prepare representations for the Minister.
