Why this cannot wait
The NOICC response deadline is typically 28 days from the date of the notice, sometimes less. Once the deadline passes, the Department can proceed to cancel your visa based on whatever information they already have. Your response is the one opportunity to present your side before the decision is made.
A response submitted after the deadline may not be considered at all. Even if the Department does consider a late response (which is not guaranteed), late submissions are given less weight than timely ones.
What a strong NOICC response includes
Your response to the Notice of Intention must directly address every ground raised in the notice with specific evidence. A general letter asking the Department not to cancel your visa is not enough. You need to respond to each concern individually.
Include statutory declarations from relevant witnesses, official documents that support your position (payslips, medical certificates, enrolment records, tenancy agreements), and a detailed personal statement explaining the circumstances. If there are compassionate factors, document them properly. Children’s birth certificates, medical reports, evidence of community involvement, length of residence in Australia, and any other factors that weigh against cancellation.
Your Notice of Intention response should be well-organised, clearly written, and easy for the decision maker to follow. The person assessing your case is reviewing dozens of matters, so make it easy for them to find the relevant information quickly.
