Is this your situation?
Your visa is expiring within weeks or days and it has a no further stay condition (8503 or 8534). You cannot apply for another visa until the condition is waived. You only just realised the condition was there, or you have been putting off dealing with it and now time is running out.
Why this is urgent
If your visa expires before the condition is waived, you become unlawful. Being unlawful means you cannot work, you lose access to Medicare, and you face detention if the Department becomes aware of you. On top of that, section 48 may apply once you are unlawful, further restricting your options.
The waiver request needs to be lodged while your current visa is still valid. The Department will not process a waiver for a condition on a visa that has already expired, because there is nothing to waive at that point.
There is also a practical timing issue. Even if you lodge the waiver request before your visa expires, the Department may not decide it before the visa ends. However, having a pending waiver request shows good faith and may support a subsequent bridging visa application.
What to do now
Lodge the waiver request as soon as possible with the strongest evidence you can compile. If you cannot prepare a perfect application in the time available, lodge what you have and provide additional evidence later. A lodged request with some evidence is better than a perfect request that arrives after your visa has expired.
